BALLSTON SPA, N.Y. (AP) – An 8-year-old boy’s lemonade stand is open for business a year after it was temporarily shut down by the New York state health department for not having a permit.
Brendan Mulvaney’s stand was shuttered last summer after a health inspector said he needed a permit to sell 75-cent lemonade. State officials said vendors at the nearby Saratoga County Fairgrounds had complained about the competition.
The health department later apologized and said the permit requirement is usually not enforced against children’s lemonade stands.
The Times Union of Albany reports that Brendan seemed unfazed by last year’s controversy as he hawked his wares Thursday. He said he was selling “normal lemonade and pink lemonade.”
A health department spokesman says the stand won’t be inspected this year.
